Why the EU AI Act Exists

  • Biometric categorisation by sensitive attributes: Inferring race, political opinions, sexual orientation, or religious beliefs from biometric data.
  • Real-time remote biometric identification in public spaces for law enforcement, with limited exceptions for serious crime.

For exams, note the structure. The prohibitions are not about the technology itself. They are about specific *uses* of the technology that cross a line. An emotion recognition system is not banned everywhere. It is banned in workplaces and educational settings.

High-Risk (Heavily Regulated)

This is where the bulk of the regulation sits. High-risk AI systems are not banned, but they carry the heaviest compliance burden. The rules for high-risk systems apply from 2 August 2026.

  • Migration and border control (visa applications, asylum claims, border surveillance)
  • Administration of justice (AI used in courts to research and interpret facts and law)

Each high-risk system must meet requirements under Articles 8-15, including:

  • A documented risk management system maintained throughout the system's lifecycle
  • Data governance measures ensuring training data is relevant, representative, and free from errors
  • Technical documentation detailed enough for authorities to assess compliance
  • Record-keeping through automatic logging of the system's operations
  • Transparency so deployers can understand and use the system properly
  • Human oversight capabilities, meaning humans must be able to monitor, override, or interrupt the system
  • Accuracy, robustness, and cybersecurity safeguards

Before placing a high-risk system on the market, providers must complete a conformity assessment, draw up an EU declaration of conformity, affix the CE marking, and register the system in the EU database.

Limited Risk (Transparency Obligations)

Limited risk systems face lighter rules, focused on making sure people know they are interacting with AI. These transparency obligations under Article 50 apply from August 2026.

The key requirement: if someone is interacting with a chatbot, they must be told it is not a human. If content has been generated or manipulated by AI (deepfakes, synthetic text, generated images), it must be labelled as such.

Minimal Risk (Unregulated)

The Implementation Timeline

The AI Act does not land all at once. It rolls out in phases, which is important for understanding which rules are already live and which are coming.

August 2024: The Act entered into force. The clock started.

February 2025: Prohibited practices (Article 5) and AI literacy obligations became enforceable. If you are deploying a banned AI system in the EU right now, you are already in breach.

August 2027: Full applicability. Remaining high-risk obligations for AI systems embedded in products covered by existing EU safety legislation (Annex I) come into force. GPAI model providers who were on the market before August 2025 must be fully compliant by this date.

The Fines: A Tiered Penalty System

The AI Act follows the GDPR playbook on penalties, scaled to the severity of the violation.

Prohibited practices violations: Up to 35 million EUR or 7% of global annual turnover, whichever is higher. This is the harshest tier and exceeds even the GDPR's maximum penalties.

High-risk and other obligations: Up to 15 million EUR or 3% of global annual turnover.

Supplying misleading information to authorities: Up to 7.5 million EUR or 1% of global annual turnover.

For SMEs and startups, the Act specifies that fines should be proportionate, capped at whichever is lower between the percentage and the fixed amount. The EU learned from GDPR enforcement that small organisations need a different calibration.

National market surveillance authorities handle enforcement at the Member State level, while the EU AI Office oversees GPAI model compliance centrally.

National Implementation: The Uneven Landscape
